Antique Identifier Terms of Service
Welcome to Antique Identifier ("the App"). These Terms of Service ("Terms") govern your access to and use of the App. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
1. Acceptance of Terms
By accessing or using Antique Identifier, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
Antique Identifier is a mobile application that uses artificial intelligence to analyze photographs of antiques and provide historical insights, appraisals, and information about artifacts. The App uses OpenAI's API to generate analysis and recommendations.
3. User Accounts and Subscriptions
- Free Tier: Users may use the App with limited functionality, including one free scan per day.
- Premium Subscriptions: The App offers premium subscription plans that provide unlimited scans and additional features. Subscription terms, pricing, and features are subject to change.
- Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage subscriptions in your device's App Store settings.
- Refunds: Refund requests are handled according to Apple's App Store policies. Contact Apple Support for subscription refunds.
4. Acceptable Use
You agree not to:
- Use the App for any illegal purpose or in violation of any laws
- Upload, transmit, or share content that is harmful, offensive, or violates others' rights
- Attempt to reverse engineer, decompile, or extract source code from the App
- Interfere with or disrupt the App's functionality or servers
- Use automated systems to access the App without permission
- Share your account or subscription with others
5. Intellectual Property
The App, including its design, features, and content, is owned by Rowan Harmon and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without express written permission.
6. AI-Generated Content
The App uses artificial intelligence to generate analysis and insights. While we strive for accuracy, the information provided is for informational purposes only and should not be considered professional appraisal, authentication, or legal advice. We are not responsible for decisions made based on AI-generated content.
7. Third-Party Services
The App integrates with third-party services, including OpenAI's API. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.
8. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.
10. Indemnification
You agree to indemnify and hold harmless Rowan Harmon and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App or violation of these Terms.
11. Termination
We may terminate or suspend your access to the App at any time, with or without cause or notice, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the App is operated, without regard to its conflict of law provisions.
