By downloading, installing, or using Stamp Identifier: AI Picture ("the App", "we", "us", "our"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.
We reserve the right to modify these terms at any time. Continued use of the App after changes constitutes acceptance of the updated terms.
Description of Service
Stamp Identifier: AI Picture is a mobile application that uses artificial intelligence to help users identify, analyze, and obtain valuation estimates for postage stamps. The App provides:
- AI-powered stamp identification and analysis
- Estimated market valuations based on current market data
- Historical context and authenticity assessments
- Collection management and scan history
- Chat functionality for follow-up questions about stamps
Important Disclaimers
⚠️ Valuation Estimates Are Not Guarantees
All valuations, appraisals, and market estimates provided by the App are estimates only and should not be considered professional appraisals or guarantees of value. Actual market values may vary significantly based on:
- Condition and preservation quality
- Market fluctuations and collector demand
- Authentication by certified philatelic experts
- Provenance and historical documentation
Always consult a certified philatelic appraiser or auction house for official valuations before making significant financial decisions.
AI Analysis Limitations
The App uses artificial intelligence to analyze stamp images. While we strive for accuracy, AI analysis may:
- Misidentify stamps, especially rare or unusual issues
- Provide incorrect historical context or catalog references
- Fail to detect reproductions, forgeries, or reprints
- Generate inaccurate valuation ranges
The App is a tool to assist in stamp identification, not a replacement for professional philatelic expertise.
No Professional Advice
The information provided by the App does not constitute professional philatelic, financial, or legal advice. We are not responsible for decisions made based on App-generated information.
User Responsibilities
You agree to:
- Use the App only for lawful purposes related to stamp collecting and identification
- Provide accurate information when using the App
- Not attempt to reverse engineer, decompile, or extract the App's source code
- Not use the App to facilitate fraud, misrepresentation, or illegal activities
- Not upload images that infringe on third-party intellectual property rights
- Maintain the security of your device and account
- Use the App in compliance with all applicable laws and regulations
Subscription and In-App Purchases
Premium Features
The App offers premium subscription plans that unlock additional features, including unlimited stamp identifications and advanced analysis capabilities.
Payment Terms
- Subscriptions are billed through the Apple App Store
- Payment will be charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel subscriptions in your Apple ID Account Settings
Free Trials
If you start a free trial, you will be charged when the trial period ends unless you cancel before the trial expires. You can cancel at any time during the trial period without being charged.
Refunds
Refund requests are handled by Apple in accordance with Apple's refund policy. We do not process refunds directly. Contact Apple Support for refund requests.
Intellectual Property
The App, including its design, code, AI models, and content, is protected by copyright, trademark, and other intellectual property laws. You may not:
- Copy, modify, or distribute the App or its components
- Use our trademarks, logos, or branding without permission
- Extract or scrape data from the App
- Create derivative works based on the App
You retain ownership of photos and content you upload. By using the App, you grant us a license to process your images through third-party AI services (OpenAI) solely for the purpose of providing stamp identification services.
Third-Party Services
The App uses OpenAI's API for AI-powered analysis. Your use of the App is also subject to:
- OpenAI's Terms of Use
- Apple's Terms of Service (for App Store purchases)
We are not responsible for the practices of these third-party services.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- The App is provided "as is" without warranties of any kind
- We do not guarantee the accuracy, completeness, or reliability of any stamp identifications, valuations, or analyses
- We are not liable for any financial losses, damages, or decisions made based on App-generated information
- We are not responsible for authentication errors, misidentifications, or valuation inaccuracies
- Our total liability shall not exceed the amount you paid for the App or subscription in the 12 months preceding the claim
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.
Prohibited Uses
You may not use the App to:
- Create false or misleading appraisals for fraudulent purposes
- Misrepresent stamp authenticity or value in commercial transactions
- Violate any laws or regulations
- Infringe on intellectual property rights
- Transmit viruses, malware, or harmful code
- Interfere with or disrupt the App's functionality
- Attempt to gain unauthorized access to our systems
Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice, for any reason including violation of these Terms of Use.
You may stop using the App at any time. Canceling your subscription will end access to premium features at the end of your current billing period.
Changes to Terms
We may update these Terms of Use from time to time. Material changes will be communicated through the App or via email when feasible. The "Effective date" at the top indicates when the terms were last updated.
Continued use of the App after changes constitutes acceptance of the updated terms.
Governing Law
These Terms of Use are governed by the laws of the jurisdiction in which the App is operated, without regard to conflict of law principles.
