Terms of Service

These Terms of Service ("Terms") govern your use of the Funnel mobile application (the "App") operated by Funnel ("we", "us", or "our"). By creating an account or using the App, you agree to these Terms.

1. The App

Funnel is a personal mood and behavior logging tool that helps you track patterns over time. The App is for self-awareness and general wellness purposes only. It is not medical advice, mental health treatment, or a substitute for professional care.

2. Accounts

You are responsible for maintaining the security of your account and for all activity under your account. You must provide accurate information and keep your login credentials confidential.

3. Subscriptions and billing

• Some features require a paid subscription ("Funnel Premium"). Prices are shown in the App before purchase and may vary by region.
• Monthly plan. The monthly subscription may include a free trial period if offered at checkout. Unless you cancel before the trial ends, your subscription automatically converts to a paid monthly subscription.
• Annual plan. The annual subscription is billed once per year unless canceled.
• Payment is processed by Apple (iOS) or Google (Android). Your purchase is subject to the applicable store's terms and refund policies.
• Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your device's App Store or Play Store account settings.
• You can restore previous purchases using the "Restore purchases" option in the App when signed in with the same store account used for the original purchase.

4. Acceptable use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to access another user's account or data
• Reverse engineer, disrupt, or overload the App or its infrastructure
• Misuse the App in a way that harms us or other users

5. Your content

You retain ownership of the information you log in the App. You grant us a limited license to store, process, and display that information solely to provide and improve the App, as described in our Privacy Policy.

6. Intellectual property

The App, including its design, branding, and software, is owned by us and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks or branding except as needed to use the App.

7. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT INSIGHTS WILL BE ACCURATE OR COMPLETE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.

9. Termination

You may stop using the App at any time and may delete your account in settings. We may suspend or terminate access if you violate these Terms or if we discontinue the App.

10. Changes

We may update these Terms from time to time. Continued use of the App after changes become effective constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws applicable in your place of residence, except where mandatory local consumer protection laws provide otherwise.
